Dino Melaye Mock court Judgment on recall, and reveals reason why he won’t obey
Kogi West senator,
Dino Melaye has yesterday denied claims that hhe was evading the service of
petition and timetable for his recall process from the senate, by the Independent
National Electoral Commission (INEC)
Dino Melaye says “The
window provided by the constitution for the service of recall petition had
elapsed and I would not be seen to be breaching the law”
“it is clear that
by the provision of section 69(b) of the 1999 constitution INEC must act on the
petition purportedly presented to it on June 23, 2017 by conducting a
referendum within 90days of receipt of the petition”.
“The time having
elapsed, I cannot under the circumstances, aid and bet INEC to further infringe
on the provision of the constitution, which I have sworn to defend”
Dino Melaye now
further assured his position by citing case such as that of Nyako VS. Adamawa State House of assembly, and All Nigerian Peoples Party ANPP VS Alhaji Mohammed Goni.
